There were high emotions and tears at an Abuja Magistrate Court yesterday when a 13-year-old girl, who was allegedly tortured by her guardian was brought to the court.
The guardian, Yemi Adetayo, of Arab Road, Kubwa was charged with cruelty to a child, an offense contrary to Section 238b of the Penal Code.
Police Prosecutor, Lukas Ephraim, told the court that the accused, on March 16 and 23 willfully ill-treated a 13-year-old girl, who was in her custody by bartering her, flogging her with a wire and dipping her right wrist into hot water with the intent to cause her pain or body injury. He further said the accused inflicted marks and injury on the back and wrist of the victim.
When the charge was read to the accused, she pleaded not guilty and the defense counsel, Akajola, pleaded the court to grant her bail on the ground that she is a nursing mother, citing Section 341 sub 2 of the Criminal Procedure Code.
The prosecutor however pleaded with the court to exert her discretion judiciously in view of the life, health and future of the victim, who also have parents.
He also pleaded that the victim be severed from the accused to avert further maltreatment, having suffered the ill treatment twice, and be temporarily kept in the custody of her aunt, who brought her from the village.
The magistrate, Rosemary Kanyip, granted her bail in the sum of N20,000 with one surety, who must be a Director in the civil service and must be resident within the court’s jurisdiction.
